Terms of Service

The contract between you and Fonhost for every service we provide.

1. Who we are

These Terms govern all services supplied by Fonhost through fonhost.com and the client area at billing.fonhost.com. Our registered office and registration details are published on this website. Contact us at support@fonhost.com for support (24/7, by ticket or email), sales@fonhost.com for sales, and abuse@fonhost.com to report abuse or a security issue. A ticket from your client area is always the fastest route, because it carries your account details.

2. Definitions

Account means your client area record and every service attached to it. Service means any shared cPanel hosting plan, managed WordPress hosting plan or reseller hosting plan, and any domain registration or renewal, SSL certificate, migration, backup or add-on we supply. Content means everything you upload, store, publish, send or process using a Service. Fees are the amounts payable for a Service. Business Day means a day other than a Saturday, Sunday or public holiday at our registered office.

3. Eligibility and account registration

You must be at least 18 and able to enter a binding contract. If you order for an organisation, you confirm you may bind it. You must give accurate details and keep them current; orders placed with false details may be cancelled. You may hold one Account; opening duplicates to repeat a new-customer offer or to evade a suspension breaches these Terms. You are responsible for everything done through your Account and your cPanel, FTP, SSH, email and database credentials: keep them secret and strong, enable two-factor authentication where offered, and tell us at once if one is compromised. You may host your own clients on your Plan, but you remain responsible for them, and you may not present yourself as Fonhost itself, or as our authorised partner or agent without our written agreement.

4. Ordering and contract formation

Our website content is an invitation to order, not an offer. Your order is an offer to buy on these Terms, and a contract is formed only when we accept it by activating the Service and confirming it in the client area. We may decline an order and refund any amount paid where fraud or sanctions screening fails, where the details cannot be verified, or where we believe the Service would be used unlawfully or in breach of these Terms. Automated provisioning normally completes within minutes of a confirmed payment; a manual review may take longer.

5. Prices, currency and taxes

All prices are in Nepalese Rupees (NPR), shown as Nrs (for example, Nrs 100 per month). Prices exclude any value added, goods and services, withholding or similar tax, which we add to your invoice and show separately where we must collect it. Promotional prices apply only for the period and plan stated and are normally limited to new orders. When a promotion ends the Service renews at the standard rate for that Plan, which is published on the plan page and shown on each renewal invoice before it is charged. We may change prices with at least 30 days notice before the change affects your renewal; if you do not accept it you may cancel before the next renewal.

6. Payment and overdue accounts

We accept the payment methods shown at checkout. Card and wallet payments are processed by a third-party processor; full card numbers never reach us. Invoices are issued in advance and are due on the issue date. You must keep a valid payment method on file. If a payment fails we may retry it and will email you, and chargeback or bank fees caused by a failed or reversed payment may be added to your Account.

7. Domains

Domains are registered through accredited registrars and are subject to the registrar and registry terms for the relevant top-level domain, which prevail over these Terms for that domain. You confirm that registering the domain infringes no third-party rights and you agree to keep the registrant data accurate and to answer verification requests. Registration, transfer and renewal fees are non-refundable once submitted to the registry, including domains given free with a hosting plan. Domains renew on the schedule shown in the client area; reminders are sent, but keeping the domain renewed is your responsibility. If a domain is not renewed it expires and is then deleted, and recovery during any registry redemption period carries an additional registry fee. You may transfer an eligible domain away at any time; we will provide the authorisation code on request, but a registry may forbid transfers within 60 days of registration or a previous transfer, and we may withhold it while an Account is suspended for non-payment or abuse. Domain disputes are decided under the relevant registry dispute policy.

8. The hosting service

We provide shared cPanel hosting, managed WordPress hosting and reseller hosting. Each Plan includes the storage, bandwidth, mailbox, database and website allowances published on its plan page, plus the platform features advertised for that tier, which may include automatic SSL, one-click application installs, a control panel, cron jobs and SFTP or SSH access. We do not offer any other type of hosting, and any request for services outside these three product families will be declined. We may change the underlying hardware, software, control panel, PHP version or datacenter, and may retire a feature a vendor has ended, provided the Service keeps meeting the specification and service levels we advertise.

9. Fair use and resource limits

Shared hosting is a pooled environment, so Plans carry fair-use limits on what one account may consume:

  • CPU: 100% of one core sustained, short bursts only, up to 60 seconds.
  • Memory: 1024 MB per process, 2048 MB per account.
  • Inodes: 200,000 on Business and Pro, 100,000 on Starter.
  • Outbound email: 500 messages per hour per account.
  • Cron jobs: minimum 5 minute interval.
  • Storage and bandwidth: the allowance of your Plan, per statement cycle.

We may throttle, cache, rate limit or briefly pause a process that exceeds these limits, and we may ask you to upgrade. Storage may not be used as a file archive, download mirror or backup vault for material that is not part of an active website or mailbox on the account.

10. Acceptable use

You must not use our Services to send spam or bulk unsolicited email, to forge mail headers, to host phishing pages, malware, ransomware or botnet control code, to publish content that is illegal where the server is located or that infringes intellectual property rights, to attack or scan any system, to run mining, cracking, proxy or torrent services, or to host child sexual abuse material. We report child sexual abuse material and the associated account data to law enforcement and child protection authorities, and terminate the Account immediately. Our Acceptable Use Policy forms part of these Terms and sets out the prohibited activity in full, how we investigate a complaint, and how to appeal an enforcement decision. Where we receive a credible abuse report we may suspend a Service while we investigate, and will restore it promptly if the report proves unfounded.

11. Your content and our platform

You own your Content and keep every right you hold in it. You grant us a worldwide, non-exclusive, royalty-free licence to store, copy, transmit, back up, cache, display and otherwise process it, but only as needed to provide, secure, monitor and support the Services you ordered, to diagnose faults, to comply with the law and to enforce these Terms. That licence ends when the Content is deleted, except for copies we must keep for legal, tax or dispute reasons and residual copies inside encrypted backups, which expire on the normal cycle. We own the platform, including our website, client area, automation, templates, documentation, trade marks and software, and you may not copy, resell or reverse engineer it beyond what the law allows. You confirm that you hold all rights and consents needed for your Content, including for any personal data it contains.

12. Backups

We take daily backups of shared and WordPress accounts as a courtesy and keep them on a rolling 30-day cycle. Courtesy backups are not a substitute for your own: you are responsible for keeping independent, verified copies of everything you cannot afford to lose. We do not guarantee that a backup exists, is complete or can be restored. We may charge a fee to restore a backup that was not needed because of a fault on our side, and backups are deleted on the normal retention cycle after termination.

13. Service levels and support

Our uptime commitment and the service credits payable if we miss it are set out in our Service Level Agreement, which forms part of these Terms and is your exclusive remedy for a failure to meet the stated availability, in place of any other credit, refund or damages. Support is available 24 hours a day by ticket and email in English, through the client area and support@fonhost.com, with billing queries handled in the client area and abuse reports at abuse@fonhost.com. Published response targets apply to the first human response, not to full resolution. Support covers the Services we provide and the platform we control; it does not extend to your application code, third-party plugins, custom development or faults outside our network.

14. Suspension, termination and refunds

We may suspend immediately, and terminate with notice, where an invoice is unpaid after the period in section 6, where you breach these Terms, the Acceptable Use Policy or the law, where a court, regulator, registrar or datacenter requires it, where a credible abuse, security or intellectual property complaint is under investigation, or where you become insolvent. Where the situation is not urgent we will contact you first and give you a reasonable chance to put it right; where immediate action is needed to protect other customers or comply with the law we may act first and explain afterwards. You may cancel any Service at any time from the client area with no termination fee, effective at the end of the period you have paid for unless you ask for earlier. On termination you have 30 days to retrieve your files, databases and email, during which a terminated account can be restored from a courtesy backup on request, subject to a fee for the work; after 30 days the Content and the backups are deleted. Domain names follow section 7. New shared and WordPress Plans carry a 30-day money-back guarantee: open a billing ticket within 30 days of your first payment and we refund the hosting fees for that order. Excluded are domain registration, transfer and renewal fees, SSL certificates, dedicated IPs and software licences, delivered add-on work such as paid migrations, renewal payments and later billing periods, and accounts terminated for breach. Our Refund Policy forms part of these Terms and sets out the full process, including how to escalate a decision. Refunds go to the original payment method within 5 to 10 Business Days.

15. Liability, warranty, indemnity and law

We will provide each Service with reasonable skill and care and comply with the laws that apply to us. Subject to that, Services are provided as is and as available, and we do not warrant uninterrupted, timely or completely secure operation, that third-party themes, plugins or applications will work, or that any Content will be preserved. Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. Subject to that, we are not liable for lost profit, revenue, business, goodwill or opportunity, for lost or corrupted data, or for indirect or consequential loss; our total liability for a Service is limited to the fees you actually paid us for that Service in the 12 months before the event giving rise to the claim; and we are not liable for events outside our reasonable control or for the acts of a third party whose service you chose to use. You agree to indemnify us against claims arising from your Content, your breach of these Terms or the law, and any infringement of third-party rights caused by your Content. These Terms are governed by the laws of the jurisdiction in which our registered office is located, and its courts have exclusive jurisdiction, except that we may bring proceedings to protect our intellectual property or recover unpaid fees in any competent court. Before formal proceedings, raise the issue in a ticket, ask for escalation to a manager if it is unresolved after 10 Business Days, and then attempt good-faith negotiation or mediation. Nothing here prevents urgent injunctive relief or a complaint to a consumer or data protection authority with jurisdiction over us.

16. General and changes

Each party will keep the other’s confidential information confidential and use it only to perform these Terms, subject to disclosure required by law; this obligation survives for three years. We send notices to the email address on your Account and by posting them in the client area or on this website, and a notice is treated as received 24 hours after sending or when posted; send notices to us through a billing ticket and, for a legal claim, also to our registered office. You may not assign your Account without our written consent; we may assign our rights to an affiliate or successor and will notify you of a transfer that changes the entity you contract with, and you may cancel within 30 days if you do not accept it. If a provision is unenforceable it is modified only as far as necessary or severed, and the rest continues to apply. These Terms, together with the Acceptable Use Policy, Privacy Policy, Cookie Policy, Refund Policy, Service Level Agreement and the terms of the Plan you ordered, are the entire agreement between us and replace anything said or written before. If we do not enforce a provision once, we may still enforce it later. We may update these Terms, and where a change materially affects your rights we will give you at least 30 days notice by email and by publishing the new version here with a new effective date; if you do not accept it you may cancel before it takes effect and we will refund any prepaid fees for the unused period.
